A long and vehement dispute once raged about the reality of universals. Are they only mental creations, forged by the human brain, without any reality outside them, or have they some independent existence apart from their mental reality? Anyhow, there was an apparent contradiction between die universal character of our ideas and the individual character of concrete things. (...) The Scholastics solved this problem by drawing clear distinctions. An idea is an abstraction; as soon as it becomes applicable to a number of objects or things in the same sense, it is a universal idea. The "direct universal" (universale directum seu metaphysicum) as such has no existence apart from our minds, because an existing thing is always bound up with concrete, determining, individualizing notes, and it is these very circumstances or accidents which are ignored by the mind as it strips the thing of its individual characteristics. When the mind reflects on this "direct universal," i.e., on the abstract essence of the thing, it sees that this is to be found in many more things and that it is identical in all those things, and in this way the "reflex or logical universal" is formed (universale reflexum seu logicum). This same essence or quiddity is not really different from the thing itself, but the mind makes abstraction of all accidents, and this foundation makes it possible to apply this idea in die same sense to all other beings of the same kind, whether they are actually existing or not. In other words the universal as a universal has only reality in the mind but it has a foundation or a ground in the thing itself. Newman was not so well acquainted with Scholasticism that he knew and mastered the solution of the problem. As a matter of fact he approached it from quite another angle. CAP.419 sistent with each other, they apparenüy imply a negation of the objective reality of universals. This makes it necessary to compare the texts and to explain his meaning. a. Newman Inconsistent. We should never lose sight of the fact that Newman had no intention at all to enter the province of philosophy in the restricted sense of the word. "I am only contemplating the mind as it moves in fact, by whatever hidden mechanism,"1 that is what could be put as a heading to every page of the Grammar of Assent. And when he virtually deals with metaphysics, he wants us to consider his statements as hypotheses, or as propositions stated only by the way, and in this department he always wishes "to speak under correction." This explains how he could refer to the universale metaphy sicum and the universale directum in a very correct way without realizing he was teaching Scholastic doctrine. As far as I know, it is Professor Walgrave who has first drawn attention to this fact,2 when he dealt with Newman's alleged conceptualism. Newman states that "even one act of cruelty, ingratitude, generosity or justice reveals to us at once intensive the immutable distinction between those qualities and their contraries; that is, in that particular instance and pro bac vice."3 The same holds for the opposites: right and wrong, true and false, just and unjust, beautiful and deformed.4 In one experience, therefore, he sees a thing as an immutable, absolute quiddity, which objectively and in the same sense belongs to all possible things of the same kind, although the mind does not yet explicidy confirm this universal applicability. The contemplated quality remains limited to the particular case; but in its absoluteness it is stripped of all individual, changeable and concrete characteristics. We had already arrived at the conclusion that Newman rejects the mere subjectivity of our knowledge. When he writes about this matter he explicitly deals with sensation or sensuous cognition. It is well known that the medieval scholastics did not begin their philosophy systematically with an explicit theory of knowledge. Unfortunately many people have concluded from that fact that the very idea of an epistemology, and especially the idea of a critique of knowledge, was completely foreign to them. Within recent years authors such as Professor Van Steenberghen and Father Copleston have done a great deal to spread a correct understanding of St. Thomas’s views on this matter. Much evidence (...) might be adduced from the principal work of John Duns Scotus to show that he also took steps to justify man’s spontaneous conviction that some natural knowledge of truth with certainty can be attained. The problem of values has given rise to a bewildering variety of theories. Louis Lavelle set himself the task of expounding and systematizing these diverse doctrines, of making “une sorte de tableau de toutes les directions dans lesquelles s’est engagée la reflection humaine au cours de son histoire, lorsqu’il s’est agi de definir pour elle la valeur absolue et les valeurs particulières”. He tried to bring order into the work of ages, situating it in a vaster order according to his (...) own views of man’s privileged place in the universe. Of course the study of values made by this great psychologist–metaphysician was far more than a lifeless gathering together of dry concepts: it involved a representation, from a new angle, of his entire philosophy of being. “Le problème essentiel de la métaphysique, le seul dont la solution puisse éclairer notre vie et guider notre conduite, c’est le problème du rapport entre l’être et la valeur”. M. Wesley Piersol now presents a fine compendium of Lavelle’s thought on value. He divides his study into four parts, aiming at thus keeping close to the line of development of the philosopher’s views. In the first part is found Lavelle’s analysis of the faculties of the moi, sentiment, will, preference, judgment of value. From this analysis is derived his understanding of the characters of value. Next comes a section on the incarnation of value by liberty in time: thus a psychology of value develops into a metaphysics of value. Finally, there is a section on the relation between axiology and ontology. The book is well planned and the matter clearly presented but, as anybody who is acquainted with Lavell’s writings must know, clarity and charm in presentation do not eliminate difficulty. (shrink)

In spite of vast global improvements in living standards, health, and well-being, the persistence of absolute poverty and its attendant maladies remains an unsettling fact of life for billions around the world and constitutes the primary cause for the failure of developing states to improve the health of their peoples. While economic development in developing countries is necessary to provide for underlying determinants of health – most prominently, poverty reduction and the building of comprehensive primary health systems – (...) inequalities in power within the international economic order and the spread of neoliberal development policy limit the ability of developing states to develop economically and realize public goods for health. With neoliberal development policies impacting entire societies, the collective right to development, as compared with an individual rights-based approach to development, offers a framework by which to restructure this system to realize social determinants of health. The right to development, working through a vector of rights, can address social determinants of health, obligating states and the international community to support public health systems while reducing inequities in health through poverty-reducing economic growth. At an international level, where the ability of states to develop economically and to realize public goods through public health systems is constrained by international financial institutions, the implementation of the right to development enables a restructuring of international institutions and foreign-aid programs, allowing states to enter development debates with a right to cooperation from other states, not simply a cry for charity. Teilhard’s cosmological speculation is a valuable basis for an environmental ethics that perceives individual natural objects as good in themselves and the world as good in itself. Teilhard perceives man as fundamentally part of a cosmic environmental whole that is greater than mankind taken individually or collectively. His holistic views on human biological and psychological and social evolution are, I argue,compatible with a biocentric environmental ethics. I discuss some similarities and differences with the views of the deep ecology movement. I (...) show that Teilhard’s hierarchical system is not humanistically oriented in a way that need be interpreted by Teilhardians as contrary to environmental well-being. I argue that Teilhard’s sympathies toward transportation technology, including the automobile, can be interpreted in his holistic manner. I conclude that Teilhard’s theocentric views are also a basis for supporting an environmental ethics which is both optimistic and not anthropocentric. (shrink)

This commentary questions the applicability of the Newell Test for evaluating the utility of connectionism. Rather than being a specific theory of cognition (because connectionism can be used to model nativist, behaviorist, or constructivist theories), connectionism, we argue, offers researchers a collection of computational and conceptual tools that are particularly useful for investigating and rendering specific fundamental issues of human development. These benefits of connectionism are not well captured by evaluating it against Newell's criteria for a unified theory (...) of cognition. (shrink)

In a lifelog, data from various sources are combined to form a record from which one can retrieve information about oneself and the environment in which one is situated. It could be considered similar to an automated biography. Lifelog technology is still at an early stage of development. However, the history of lifelogs so far shows a clear academic, corporate and governmental interest. Therefore, a thorough inquiry into the ethical aspects of lifelogs could prove beneficial to the responsible development of (...) this field. This article maps the main ethically relevant challenges and opportunities associated with the further development of lifelog technologies as discussed in the scholarly literature. By identifying challenges and opportunities in the current debate, we were able to identify other challenges and opportunities left unmentioned. Some of these challenges are partly explained by a blind spot in the current debate. Whilst the current debate focuses mainly on lifelogs held by individuals, lifelogs held by governmental institutions and corporations pose idiosyncratic ethical concerns as well. We have provided a brief taxonomy of lifelog technology to show the variety in uses for lifelogs. In addition, we provided a general approach to alleviate the ethical challenges identified in the critical analysis. (shrink)

Given its non-invasive nature, there is increasing interest in the use of transcutaneous vagus nerve stimulation across basic, translational and clinical research. Contemporaneously, tVNS can be achieved by stimulating either the auricular branch or the cervical bundle of the vagus nerve, referred to as transcutaneous auricular vagus nerve stimulation and transcutaneous cervical VNS, respectively. In order to advance the field in a systematic manner, studies using these technologies need to adequately report sufficient methodological detail to enable comparison of results between (...) studies, replication of studies, as well as enhancing study participant safety. We systematically reviewed the existing tVNS literature to evaluate current reporting practices. Based on this review, and consensus among participating authors, we propose a set of minimal reporting items to guide future tVNS studies. The suggested items address specific technical aspects of the device and stimulation parameters. We also cover general recommendations including inclusion and exclusion criteria for participants, outcome parameters and the detailed reporting of side effects. Furthermore, we review strategies used to identify the optimal stimulation parameters for a given research setting and summarize ongoing developments in animal research with potential implications for the application of tVNS in humans. Finally, we discuss the potential of tVNS in future research as well as the associated challenges across several disciplines in research and clinical practice. (shrink)

To characterize human emotions, researchers have increasingly utilized Automatic Facial Expression Analysis (AFEA), which automates the Facial Action Coding System (FACS) and translates the facial muscular positioning into the basic universal emotions. There is broad interest in the application of FACS for assessing consumer expressions as an indication of emotions to consumer product-stimuli. However, the translation of FACS to characterization of emotions is elusive in the literature. The aim of this systematic review is to give an overview of how FACS (...) has been used to investigate human emotional behavior to consumer product-based stimuli. The search was limited to studies published in English after 1978, conducted on humans, using FACS or its action units to investigate affect, where emotional response is elicited by consumer product-based stimuli evoking at least one of the five senses. The search resulted in an initial total of 1,935 records, of which 55 studies were extracted and categorized based on the outcomes of interest including (i) method of FACS implementation; (ii) purpose of study; (iii) consumer product-based stimuli used; and (iv) measures of affect validation. Most studies implemented FACS manually (73%) to develop products and/or software (20%) and used consumer product-based stimuli that had known and/or defined capacity to evoke a particular affective response, such as films and/or movie clips (20%); minimal attention was paid to consumer products with low levels of emotional competence or with unknown affective impact. The vast majority of studies (53%) did not validate FACS-determined affect and, of the validation measures that were used, most tended to be discontinuous in nature and only captured affect as it holistically related to an experience. This review illuminated some inconsistencies in how FACS is carried out as well as how emotional response is inferred from facial muscle activation. This may prompt researchers to consider measuring the total consumer experience by employing a variety of methodologies in addition to FACS and its emotion-based interpretation guide. Such strategies may better conceptualize consumers' experience with products of low, unknown, and/or undefined capacity to evoke an affective response such as product prototypes, line extensions, etc. (shrink)

Lifestyle diseases constitute an increasing proportion of health problems and this trend is likely to continue. A better understanding of the responsibility argument is important for the assessment of policies aimed at meeting this challenge. Holding individuals accountable for their choices in the context of health care is, however, controversial. There are powerful arguments both for and against such policies. In this article the main arguments for and the traditional arguments against the use of individual responsibility as a criterion for (...) the distribution of scarce health resources will be briefly outlined. It is argued that one of the most prominent contemporary normative traditions, liberal egalitarianism, presents a way of holding individuals accountable for their choices that avoids most of the problems pointed out by the critics. The aim of the article is to propose a plausible interpretation of liberal egalitarianism with respect to responsibility and health care and assess it against reasonable counter-arguments. (shrink)

Research has shown that individuals with high levels of psychopathic personality traits are likely to cause harm to others in the workplace. However, there is little academic literature on the potentially adaptive outcomes of corporate psychopathy, particularly because the “boldness” psychopathy domain has largely been under-acknowledged in this literature. This study aimed to elaborate on past findings by examining the associations between psychopathy, as operationalized using scales from the relatively new triarchic model of psychopathy, and both adaptive and maladaptive workplace (...) behaviors. Participants were 343 working community adults who completed a series of self-report questionnaires that measured psychopathy and various workplace behaviors, including counterproductive work behaviors, tactics of influence, unethical decision-making, leadership strategies, team play, and creativity. Structural equation modeling was used to estimate the associations between latent constructs of boldness, meanness, and disinhibition, and the eight different constructs related to workplace behaviors. It was found that boldness preferentially predicted the use of soft tactics of influence, adaptive leadership, and team play, and negatively predicted passive leadership. Meanness predicted unethical decision-making, poor team play, and hard tactics of influence. Disinhibition positively predicted CWB and passive leadership. Meanness also moderated the association between disinhibition and CWB, in that greater scores on both psychopathy domains indicated greater levels of CWB. These findings provide conceptual support for the triarchic model, including the “boldness” domain, which measures adaptive aspects of psychopathy in addition to maladaptive ones, as well as suggest that not all individuals high on psychopathy would be an overt menace to the workplace. The different psychopathy traits may also interact with each other to predict different types or levels of workplace behaviors. (shrink)

The titles of the essays included are: 1) The Birth of the Writings and Constitution of the Canon (...) ; 2) Francis, Theology and the Letter to brother Anthony ; 3) Anthony cites Francis: the Epilogue of the Sunday Sermons and the Early Rule XVI ; 4) The Writings between Francis and his secretaries: a Knot to be Untied ; 5) Concerning the Autographs of brother Francis: Doubts, Verifications and Confirmations ; 6) Concerning the Authenticity of the Writings of Francis to the "Poor Ladies" ; 7) The Lesser Brothers and Books: Concerning the Exegesis of "the books necessary to fulfill their office" and "Those who do not know how to read" . Each of the essays displays a careful methodology and appreciation for the evangelical content of the texts.The first essay deals with the establishment of the "canon" of Francis's writings in which the author demonstrates that the writings are born and develop from Francis's relationship with the Word of God. In this context, "writing" takes on the character of an "essential moment" in Francis's relationship with the Word , with God and with the brotherhood. This explains for Paolazzi, the passion with which Francis recommends the writings to those to whom they are addressed.The second and third essays are related to Anthony of Padua and the writings. The second essay deals with the content and authenticity of the Letter to Anthony, included by Kajetan Esser in the canon of Francis's writings. Paolazzi argues that the expression, "Brother Anthony my bishop" goes back to Francis himself. He suggests that Anthony's request for permission to teach reflects the concern of the novice who had permission from his minister to have a breviary, but was uncomfortable and needed Francis's explicit permission , a characteristic of the tension in the brotherhood upon Francis's return from Egypt in 1220. The conditions Francis places on the teaching of Anthony reflect Francis's concern that the Word of God not be approached purely from an intellectual perspective, but rather as a Word which must transform life. The third essay attempts to demonstrate that the Epilogue to Anthony's Sunday Sermons integrates sections of chapter 17 of the Early Rule. Paolazzi concludes this careful lexical study with the affirmation that Anthony had the Early Rule's exhortation to preachers in chapter 17 before his eyes as he concluded his Opus Evangeliorum .In the fourth essay Paolazzi tackles the question of the role played by secretaries in the production of the Writings of Francis. Scholars, including Esser, have suggested that because of his health and/or because of his status as "illiterate," Francis depended on secretaries to put his thoughts on paper. Paolazzi approaches the question by citing a saying attributed to Francis from the Mirror of Perfection . That this saying goes back to the historical Francis Paolazzi concludes based on both the content and the fact that it reflects Francis's literal approach to the Gospel. The saying states that Francis wanted no one to call him good, father or master because of the teaching of Christ in the Gospel who said that only God should be addressed with these titles . He then studies the usage and appearance of these three terms in the Writings of Francis, which confirm a consistent usage in accord with this saying. This demonstrates that the Writings reflect the "speech" of Francis and not simply his conceptual thought. The aims of the paper are (i) to introduce a framework for reasoning about equity in health distribution before and after interventions, and (ii) to assess various Gini measures applied to healthy life expectancy against explicit normative concerns. Part 1 discusses different ways of measuring pure health inequality and suggests that a modified Gini measure could be used to measure inequity in health before and after treatment. Part 2 introduces a framework for reasoning about distributions of health. Part 3 discusses (...) three normative concerns that any acceptable measure of inequity should satisfy. Part 4 describes the standard Gini measure for measuring pure inequalities in healthy life expectancy. It also examines Wagstaff's Extended Gini measure of health inequity and discusses how it can be used to make priority weights to the worst off explicit. The final section expresses some programmatic worries and possible applications. It is argued that the impact of interventions should be evaluated both in terms of reduced inequity (as measured by the Extended Gini or the Extended Proportional Gini) and improved efficiency (measured by gains in average healthy life expectancy). Measurement of pure health inequity could supplement cost-effectiveness analysis as a basis for fair priority setting. (shrink)

This article is an attempt to evaluate the Oregon plan from the perspective of a Scandinavian national health care system. The Nordic welfare states are marked by a strong emphasis on equality. As an example of an egalitarian system we present the Norwegian health care model in part one. In part two, the arguments in favor of a one tier system in Norway are presented and compared to Oregon's two tier system. Although we argue, in part three, that a comparison (...) of the degree of explicitness in the prioritization process shows that Norway has much to learn from Oregon, we do believe that the Norwegian system has some attractive elements that may function as an important corrective. In part four we present the Norwegian Guidelines for priority-setting and discuss the weight assigned to the severity of disease criterion. It is argued that the exclusion of information about the severity of disease partly explains the counterintuitive ranking of treatment-condition pairs in Oregon's initial method based on the principle of health maximization. A normative analysis of the conflicting norms of efficiency and equality of results is called for. The final part of the paper is devoted to the problem of rigidity. Henry J. Aaron has argued that the Oregon system is insensitive to inter-individual variations within each diagnosis-treatment pair. This objection is a severe one, since the system might end up treating patients unfairly on the individual level. To overcome this problem, we suggest a selection rule that should be more capable of dealing with the problem of rigidity. (shrink)

In the last number of years scholars have discovered many new “parallels”2 to Francis of Assisi’s Admonitions.3 In this article I will provide more new parallels that I have uncovered not only in ecclesiastical contexts, but also in non-ecclesiastical ones.4 While almost all students of Francis’ Admonitions are acquainted with the general ecclesiastical contexts, most are unfamiliar with the non-ecclesiastical contexts evidenced by Cato’s Distichs, Daniel of Beccles’ Urbanus Magnus, Egbert of Liège’s The Well-Laden Ship, the Facetus, and a (...) fourteen-volume collection of medieval proverbs. In the last years of its history, the Ukrainian ethnic group faced numerous external and internal challenges, which, to a large extent, were the result of its previous genesis and profound transformations in public consciousness. At the same time, one of the central stereotypes of the domestic political and legal mentality is the idea of truth and justice as a basic social ideal and the basis of the legal order. Analysis of research and publications. The problem of mentality and the (...) formation of behavioral stereotypes has been of interest to domestic and foreign scientists for a long time. The concept of «mentality» is most widespread in the writings of the French historical school «Annals». The scientific work of M. Blok, F. Braudel, M. Vovel, J. Le Hoff, J. Lefebvre, L. Fevre, R. Mandr and other scientists reveals the content of mentality and its structures, as well as the peculiarities of their influence on everyday life and activities of individuals who lived in different historical eras. The purpose and objectives of the article. In this article, the authors aim to analyze the idea of truth-justice as a tool for transforming the legal mentality of the Ukrainian ethnic group and to show its influence on the content of its behavioral stereotypes. Research methodology. The methodology of this research has a complex nature and is based on a socio-philosophical and philosophical-legal analysis of the behavioral guidelines of Ukrainians in the field of legal understanding. The results. The social ideology, developed on the basis of ancient social ideas and stereotypes of the national legal mentality, should become a tool for correcting such destructive phenomena in the state-building discourse as legal nihilism, anarchism, civic passivity, corruption, nepotism, etc. At the same time, the concepts of truth-justice, will-freedom and fraternity-equality are key in Ukrainian legal culture. Discussion. The interpretation of this idea in scientific opinion is not unambiguous. This idea clearly manifests itself in the context of the opposition between Truth and Evil in the national culture. Truth is inseparable from human existence and daily activities. The idea of truth is closely related to the idea of justice, which, according to many researchers, is a later, more rational and clearly defined phenomenon derived from truth. Justice as a socio-philosophical phenomenon is intended to act as a kind of moral measure of relations between individuals in society. It is considered as an authoritative criterion for establishing the correspondence between the nature of human activity and its assessment by the social community. Conclusions. Destructive behavioral stereotypes of the Ukrainian ethnic group that were formed, among other things, under the influence of factors of stressogenesis can be corrected with the help of the legal ideology of state building, which should be based on the content of the idea of truth and justice. The developed ideology should be based on the most stable constructive guidelines of the national legal mentality, organically complementing and ideologically justifying them. (shrink)

In a discussion-note in Mind, Father P. M. Farrell, O.P., gave an account, in what he admitted to be an embarrassingly brief compass, of the Thomist doctrine concerning evil. There is one sentence in this discussion which at first glance appears paradoxical. Father Farrell has been arguing that a universe containing ‘corruptible good’ as well as incorruptible is better than one containing ‘incorruptible good’ only. He continues: ‘If, however, they are to manifest this corruptible good, they must be corruptible (...) and they must sometimes corrupt.’ The final words, despite Father Farrell's italics, strike one as expressing, not a self-evident truth, but a non sequitur. The fact that I am capable of committing murder does not entail that I will at some time commit it. It is not immediately obvious that a similar entailment holds in the case of corruption and corruptibility. (shrink)

En esta ponencia nos proponemos mostrar que ciertas tesis o consensos recibidos sobre pseudoprocesos causales , procesos cuya característica prominente parece ser superar la velocidad de la luz, deben ser cuestionados o seriamente modificados. Dos de dichos consensos son, primero, que los PSP deberían ser tratados simplemente como "basura espacio-temporal" y, segundo, que ellos no cumplen, aparte de permitir aislar procesos causales genuinos, ninguna función epistémica o metodológica en la descripción de cualquier estado físico, en particular, al interior de la (...) relatividad especial . Para ello, apelaremos a procedimientos de medición física bien conocidos tanto en física clásica como en RE. Como consecuencia de lo anterior, argumentamos que, una vez que los PSP son integrados en toda la escena física, se revela que ellos juegan un rol fundamental y más complejo en la física experimental de lo que hasta ahora se ha pensado. In this paper we show that some received contentions about causal pseudo processes , processes of which the most salient aspect seems to be travelling faster than the speed of light, must be rejected o seriously modified. Two of such contentions are, first, that PSPs should be considered just "spatiotemporal junk" and, second, that they do not meet, besides allowing us to isolate proper genuine causal processes, any other epistemic or methodological role in the description of a physical state of affair, in particular, in a special relativity setting. In order to do that, we are going to appeal to physical measure procedures, well known both in classic and relativistic physics. As a consequence of that, we contend that, once PSPs are integrated into the whole physical scenario, a fundamental and more complex role for them in experimental physics is revealed. (shrink)

Introduction Hundreds of thousands of premature neonates born in low-income countries are implicitly denied treatment each year. Studies from India show that treatment is rationed even for neonates born at 32 gestational age weeks (GAW), and multiple external factors influence treatment decisions. Is withholding of life-saving treatment for children born between 28 and 32 GAW acceptable from an ethical perspective? Method A seven-step impartial ethical analysis, including outcome analysis of four accepted priority criteria: severity of disease, treatment effect, cost effectiveness (...) and evidence for neonates born at 28 and 32 GAW. Results The ethical analysis sketches out two possibilities: (a) It is not ethically permissible to limit treatment to neonates below 32 GAW when assigning high weight to health maximisation and overall health equality. Neonates below 32 GAW score high on severity of disease and efficiency and cost-effectiveness of treatment if one gives full weight to early years of a newborn life. It is in the child's best interest to be treated. (b) It can be considered ethically permissible if high weight is assigned to reducing inequality of welfare and maximising overall welfare and/or not granting full weight to early years of newborns is considered acceptable. From an equity-motivated health and welfare perspective, we would not accept (b), as it relies on accepting the lack of proper welfare policies for the poor and disabled in India. Conclusion Explicit priority processes in India for financing neonatal care are needed. If premature neonates are perceived as worth less than other patient groups, the reasons should be explored among a broad range of stakeholders. (shrink)

Considering the difficulty of Heidegger’s work this short expository and critical study is worthy of note as being both readable and scholarly. It should prove very helpful to those who have already some acquaintance with the general lines of Heidegger’s philosophy.

Duquesne University has already given us a number of works on the philosophy of nature, which is one of the most difficult and important parts of philosophy. Those of Van Melsen and Van Laer in particular will be recalled. The author of the present work, Fr. Koren, who became editor of Duquesne Studies in 1952, has already published a textbook on Metaphysics, reviewed in Vol. VII of Philosophical Studies, and another on the Philosophy of Man. The purpose of this book is to show that “far from being an enemy of Natural Law, Burke was one of the most eloquent and profound defenders of Natural Law morality and politics in Western civilization”. Professor Stanlis rightly points out that Burke was for too long treated as a utilitarian in politics, and he blames such writers as Morley, Stephen and Vaughan, who were mainly responsible for this interpretation. He might have added that Burke himself must bear part (...) of the blame: is he not famous for his rejection, in his American speeches, of all appeals to “abstract” or natural rights? “I do not enter into these metaphysical distinctions; I hate the very sound of them …”. “The question with me is, not whether you have a right to render your people miserable; but whether it is not your interest to make them happy”. Such phrases sound rather like utilitarianism; and the impression is strengthened by Burke’s famous denunciation of the whole “Rights of Man” school in his Reflections on the Revolution in France: “How can any man claim, under the conventions of civil society, rights which do not so much as suppose its existence? Rights which are absolutely repugnant to it? … In the gross and complicated mass of human passions and concerns, the primitive rights of men undergo such a variety of refractions and reflections, that it becomes absurd to talk of them as if they continued in the simplicity of their original direction.… The pretended rights of these theorists are all extremes; and in proportion as they are metaphysically true, they are morally and politically false.… The rights of men in government are their advantages.… The body of the community … has no right inconsistent with virtue, and the first of all virtues, prudence. Objective: To provide an ethical analysis of whether the Ethiopian and Tanzanian national HIV/AIDS treatment guidelines can be considered legitimate and fair rationing tools.Method: Qualitative study and ethical analysis involving guideline documents and interviews with nine key members involved in the development of the guidelines. The analysis followed an editing organising style. The theoretical framework was a guideline-specific framework based on theories of just resource allocation in healthcare and conditions that ensure fair processes in guideline development. According to this framework, (...) legitimate rationing requires reasons for patient selection to be explicit, public and relevant, and decisions must be open to question and revision.Results: The only explicit rationing criteria that both guidelines recommended were clinical antiretroviral treatment indications. Explicit non-clinical rationing criteria were expressed in a separate Ethiopian implementation guideline. Neither of the guideline development processes fully satisfies minimal requirements of procedural fairness. There is a lack of transparency. The reasons for decisions are rarely given and are not publicly available. This reduces the opportunity for public questioning, debate and revisions. The guidelines were based on expert opinion and consensus. Recommendations from the WHO were copied without much discussion, disagreement or adjustment.Conclusions: The two national HIV treatment guidelines discussed are de facto mechanisms for rationing but were developed using methods that do not fully satisfy the requirements of fair processes. Hense also included a reference to Philodemus, Rhetorica 2.55 Sudhaus, where τν Βορυσθενίτην is mentioned, but gave no further treatment of this item. In my edition of the testimonies to and fragments of Bion I did not include this passage, not because the name Bion does not occur, but because I did not think that it really was a reference to (...) Bion. As M. Gigante and G. Indelli have objected to this procedure and seem to be convinced that the passage really is a definite reference to Bion of Borysthenes, I think it deserves a somewhat closer interpretation. Este trabajo tiene como objetivo presentar la cuestión de las habitualidades en la fenomenología de Husserl para pensar la génesis de la reflexión en nuestro mundo actual. En un primer momento, y principalmente a partir de libros primero y segundo de las Ideas relativas a una fenomenología pura y una filosofía fenomenológica, se revisarán el concepto de yo en Husserl en dos de sus dimensiones principa-les: el yo como polo idéntico de las vivencias y el yo como substrato de las (...) habitualidades. Después realizaremos un análisis sobre la génesis de las habitualidades y su repercusión en el concepto de yo puro. Por último se ejemplificará esta cuestión en el caso de la reflexión, especialmente en el caso de una posible génesis negativa de la reflexión en forma de reflexi-vidad ritual o hiperreflexividad. Con ello se quiere establecer una línea de conexión entre la subjetividad trascendental y nuestro mundo concreto, así como entre la fenomenología y la psicopatología.The aim of this work is to present the question regarding to the habitualities in Husserl´s Phenomenology in order to think the genesis of reflection in our present world. In a first stage, and specially acording to the first and second book of Ideas [...] the concept of "I" will be considered in its two main dimen-sions: the I as identical pole of the lived-experiences and the "I" as substratum of habitualities. Afterwards, I will perfom an analysis on the genesis of the habitualities and its consecuences in the in the concept of pure I. In the last part this question will be ejemplied though the case of reflection in the form of a Ritual Reflectivity or Hypereflectivity. Whitin I would like to suggest the link conection be-tween the trascendental subjectivity and our concrete world, and the phenomenology and psychopathology relationship as well. (shrink)

Actuality of the conducted research is practically oriented character. Without the use of information and communication technologies in the field of higher education, it is impossible to carry out qualitative training of specialists in engineering, the results of which are necessary for the implementation of a national strategy for modernizing the economy and forming a progressive state of European type. Formulation of the task - the specificity of the use of ICT in the system of higher education has not been (...) studied sufficiently. ICT form a complex environment, which includes a lot of information objects and the links between them. It can be argued that the structural and functional analysis of the use of ICT in higher education is the basis of the theoretical justification in the formation of technical professionalism of future engineers. ICTs form a complex system, which includes not only technical and software-hardware capabilities, but also psycho-pedagogical, organizational, methodological. Without taking into account all of these components, as well as the needs of the subjects of the educational process, the use of ICT tools may be accompanied by risks and negatively affect the quality of high education. The use of information technologies in the educational process is the foundation of innovative development of the educational system. The rapid development of ICT provides not only significant pace of innovative progress, but also requires the definition of information resources that guarantee the quality of learning, the choice of techniques that are in line with the general strategy for the formation of professional competences. Therefore, the problem of choosing an approach to the process of learning with the use of ICTs remains one of the main tasks of education. Research methods. In theory and practice, the study of the application of information and communication technologies in high school uses empirical methods of collecting and analyzing information based on the results of the survey of 120 students. Presenting main material. The essence of professionalism of future specialists of the technical direction is revealed. The scientific point of view on the professionalism of the engineer is presented. The peculiarities of formation of the basis of technical professionalism of future engineers in the process of studying at a higher school are theoretically grounded. The quantitative and qualitative analysis of the results of empirical researches of this problem is presented. The practical significance of the research topic is that the innovative approaches to the training of specialists in engineering specialties are differentiated, which differentiate in the educational concepts of teaching in higher educational institutions of European countries. The article explores some neglected aspects of Kierkegaard's view on Ethics. The author of the article takes into account that the well-known view of ethics provided in Either-Or ii is suspended by the time Kierkegaard publishes Fear and Trembling. Nevertheless, the aim of this article is precisely to show that things are not that simple. The author begins with the view of ethics embedded in The Concluding Unscientific Postscript, and then takes up a more wide-angle view linked to Kierkegaard's (...) notion of the Sublime, which uncovers a passionate motion toward ethics as what one is and can be. The view focused by Subjectivity" is followed by the view focused by The Sublime and Perfectionism. /// O presente artigo explora alguns dos aspectos mais negligenciados nos estudos acerca da visão kierkegaardiana da Ética O autor do artigo toma em consideração o facto de que a perspectiva sobre a vida ética proposta por Kierkegaard na segunda parte da obra Alternativa parece estar já superada no momento em que Kierkegaard publica Temor e Tremor. Apesar disso, objectivo do artigo é precisamente mostrar que as coisas não são assim tão simples. O autor começa com a visão da Ética proposta na obra Post-Scriptum, avançando uma perspectiva mais ampla do ético associada com a noção kierkegaardiana de Sublime, noção essa que desvela um movimento apaixonado para a Ética entendida como aquilo que se é e que se pode vir a ser. Nesse sentido, a perspectiva do ético focalizada na noção de Subjectividade é seguida pela perspectiva focalizada nas noções de Sublime e de Perfeccionismo. (shrink)
